PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of certiorarified mandamus calling for the records relating to Crl.M.P.No. 260 of 2025, on the file of the learned Chief Judicial Magistrate, Tenkasi, and quash the order dated 15.04.2025 passed therein and consequently remit the matter to the learned Chief Judicial Magistrate, Tenkasi, to pass fresh orders in accordance with law, after affording a fair and effective opportunity of hearing to the petitioner within a time stipulated by this Court. [Order of the Court was made by DR.G.JAYACHANDRAN, J.] The order, dated 15.04.2025, passed in Crl.M.P.No.260 of 2025, by the learned Chief Judicial Magistrate, Tenkasi, under Section 14(1) of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2022 (in short, the "SARFAESI Act"), is under challenge in this writ petition.

2. A reading of the affidavit filed in support of this writ petition indicates that there is a title dispute over the property, which is the subject matter of the SARFAESI proceedings. The petitioner has to work out his remedy before the appropriate Court. We are not inclined to interfere with the proceedings initiated under SARFAESI Act, which is a composite Act and having adequate remedies for the person aggrieved.

3. Accordingly, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed. [G.J., J.] [K.K.R.K., J.] 19.12.2025 NCC :
