COMMON ORDER Crl.O.P(MD).No.22815 of 2025 has been filed to quash the charge sheet in S.C.No.26 of 2022 on the file of the Fast Track Mahila Court, Sivagangai District.

Crl.O.P(MD).No.22863 of 2025 has been filed to quash the charge sheet in C.C.No.224 of 2025 on the file of the learned Judicial Magistrate, Manamadurai, Sivagangai District. 3.The case of the prosecution in Crl.O.P.(MD) No.22815 of 2025 is that the second respondent/defacto complainant and the first petitioner/A1 are close relatives; that they were in a romantic relationship; that on the promise of marrying the second respondent/defacto complainant, the first petitioner/A1 had sexual intercourse on several occasions; that thereafter, the first petitioner/A1 avoided her calls and subsequently refused to marry her; and that the second respondent/defacto complainant attempted to commit suicide. 3/7

4.The case of the prosecution in Crl.O.P.(MD) No.22863 of 2025 is that on account of the aforesaid enmity, the first petitioner/A1 along with others threatened the second respondent/defacto complainant (the first accused in the other case) stating that if he did not marry the sixth petitioner/A6 (the victim), they would not allow him to live; and that on the instigation of the sixth petitioner/A6, seventh petitioner/A7, and eighth petitioner/A8 on 17.08.2020 at about 08:15 p.m., when the second respondent/defacto complainant was walking near Idakattur Siddhar Temple, the petitioners, who were waiting there, wrongfully restrained and attacked him with deadly weapons, caused bleeding injuries and threatened him with dire consequences. Thereafter, the second respondent/defacto complainant was admitted in the hospital.

5. When the matter was taken up for hearing on 19.12.2025, it is reported that the parties have entered into a compromise and filed Joint Compromise Memos in both cases. Therefore, this Court, after recording the compromise arrived at between the parties, directed the 4/7

first petitioner in Crl.O.P(MD).No.22815 of 2025 to pay a sum of Rs.1,00,000/- (Rupees Ond Lakh only) by drawing a demand draft in favour of the victim, i.e., the second respondent /defacto complainant in Crl.O.P(MD).No.22815 of 2025 and the matter was posted on 23.01.2026 'for reporting compliance'. Thereafter, when the matter was listed 'for reporting compliance' on 23.01.2026, it is reported that the order of this Court dated 19.12.2025 has been complied with. Therefore, this Court recorded no further order is required. However, the relief sought for was not reflected in the aforesaid order. Hence, today i.e., 16.02.2026, this matter was directed to be listed under the caption 'for being mentioned' at the instance of the learned counsel for the petitioners and the order dated 23.01.2026 is recalled.

In view of the abovestated compliance, the impugned charge sheets in S.C.No.26 of 2022 on the file of the Fast Track Mahila Court, Sivagangai District and C.C.No.224 of 2025 on the file of the learned Judicial Magistrate, Manamadurai, Sivagangai District, are hereby quashed and accordingly, these Criminal Original Petitions are allowed. 5/7

The joint compromise memos dated 11.12.2025 shall form part and parcel of this order.
