PRAYER :- For Bail in Crime No.17 of 2025 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 25.10.2025 for the offences punishable under Sections 318 (4) of BNS, 2023 and Section 66(D) of Information Technology Act, in Crime No.17 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioners herein are received a sum of Rs.77,000/- from the defacto complainant for the supply of bricks and thereafter, cheated him. Hence, the complaint.

3. The learned counsel for the petitioners submitted that the petitioners are innocent and have not committed any of the offences alleged by the prosecution. He further submitted that the petitioners had already handed over a Demand Draft for a sum of Rs.77,000/- to the de facto complainant and, on that basis, interim bail was granted to the petitioners on 23.01.2026. He also submitted that the petitioners have paid amounts to several victims and had handed over a Demand Draft for 2/6

a sum of Rs.85,000/- to the victim/A.Jaisingh. It was further submitted that the balance amount would be paid within two months, i.e., on or before 13.04.2026. Hence, he seeks bail for the petitioners.

4. The learned Additional Public Prosecutor submitted that the petitioners have paid the amounts to the de facto complainant and to one Jaisingh. However, he opposed the grant of bail on other grounds.

5. Taking into consideration of the facts and circumstances of the case and also the fact that the petitioners have settle the issues. Further, the petitioners have complied with the conditions imposed by this Court. Hence, the interim bail already granted by this Court dated 23.01.2026 is made absolute on the following conditions.

[a] The petitioners shall report before the respondent police as and when required for interrogation. Further, the petitioners are directed to pay the balance amount to the victim, within a period of two months on or before 13.04.2026.

[b] the petitioners shall not tamper with the evidence or witness either during investigation or trial. 3/6

[c] the petitioners shall not abscond either during investigation or trial.

[d] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners are released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[e] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
