O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first respondent to remove the entry of the fifth respondent's name from the present computer Patta No.1359 and directing the second respondent to issue patta in favour of the petitioner in respect of the property situated in Survey No.398/43, Chokkathevanpatti Village, Usilampatti Taluk, Madurai District.

With the consent of the learned counsel for the petitioner and the learned Government Advocate appearing for the first to fourth respondents, this Writ Petition is taken up for final disposal at the admission stage itself, dispensing with notice to the fifth respondent, as no adverse orders are proposed to be passed against him. The learned counsel appearing for the petitioner would submit that the subject property belongs to the petitioner; that the second respondent has erroneously issued a digitised patta in the joint names of the fifth respondent and the petitioner in Patta No.1359 on 12.06.2025; and that since the fifth respondent, using the same, is attempting to sell the petitioner's property, the petitioner prays for a direction to remove the name of the fifth respondent from the patta and issue a fresh patta in the name of the petitioner.

The learned Government Advocate appearing for the first to fourth respondents would submit that once the petitioner submits a fresh representation/application, the same would be considered and appropriate orders would be passed on merits and in accordance with law, to which the learned counsel for the petitioner would accede.

Recording the above submissions and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the petitioner to submit a fresh representation/application to the first respondent for removal of the fifth respondent's name from the joint patta and for issuance of a fresh patta, within a period of two weeks Page No. 3 of 6

from the date of receipt of a copy of this order. On receipt of such representation/application, the first respondent shall consider the same on its merits and in accordance with law and pass appropriate orders within a period of ten weeks thereafter. The said representation/application shall be considered and disposed of after conducting an enquiry. The first respondent is also directed to afford a reasonable opportunity of hearing during such enquiry to the petitioner, the private respondent and any other interested parties who may be affected by the decision. There shall be no order as to costs.
