ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondents to issue the petitioner patta by sub division for his property bearing S.No.445/1 present S.No.445/1B2 situated at Jangalpatti Village, Theni Taluk, Theni District, in the light of his online application for patta by sub division vide application No.2025/0105/204855 dated 02.08.2025 on the file of the first respondent.

2. Heard the learned counsel appearing for the parties.

3. According to the petitioner, he has submitted an online application dated 02.08.2025 for patta by sub division for his property. Thereafter, on 06.10.2025 the first respondent has sent a letter to the second respondent directing the second respondent, Village Administrative Officer and Revenue Inspector to inspect the land, verify the records and submit a report upon the petitioner's application and also sent a copy of the said letter to the petitioner. The second respondent inspected the land of the petitioner with the records and found that one

Muthulakshmi has filed a writ appeal in WA(MD) NO.3065 of 2025 as against the brother of the petitioner and in W.P(MD) No.18512 of 20222 and order was passed in the writ petition on 09.01.2025 and there is no stay granted and the writ petition stands posted to 09.12.2025. Under these circumstances when the petitioner approached the respondents to grant patta the respondents did not consider the request and cited that writ appeal is pending, hence the present writ petition has been filed.

4. The learned Government Advocate for the respondents submits that the petitioner's representation will be considered on its merits and in accordance with law.

Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the first respondent to consider the petitioner's online application dated 02.08.2025, on merits and in accordance with law and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order. The representation shall be considered and disposed of after conducting an enquiry.

The first respondent is directed to provide reasonable opportunity during such enquiry to the petitioner and also to the other persons, who may be affected by such decision.
