PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records relating to the proceedings of the 1st respondent in File No. MD2076945560724 dated 30.09.2024 and quash the same consequently direct the 1st respondent herein to renew / re-issue the petitioners passport No. M4024977 for its full validity of 10 years without insisting on any Court Order or No Objection Certificate, within such time as may be stipulated by this Court. ORDER

The present writ petition has been filed seeking a mandamus as against the first respondent for re-issuance of the passport of the petitioner for a full period of 10 years.

2. According to the learned counsel appearing for the third respondent, the petitioner has been implicated in a criminal case in Crime 2/4

No.151 of 2023 on the file of the third respondent. It has culminated in filing of a charge sheet in S.T.C.No.1592 of 2023 on the file of the learned Judicial Magistrate Court, Tenkasi. The said proceedings are still pending.

3. In view of the above said facts, the petitioner is directed to approach the concerned trial Court seeking permission of the Court to go abroad. In case if any such application is filed, the same shall be disposed of within a period of four weeks from the date of receipt of a copy of this order. Depending upon the order to be passed by the trial Court, the first respondent is directed to proceed in accordance with law.

4. With the said observations, the Writ Petition stands disposed of. No costs. Consequently, connected miscellaneous petitions are closed.
