ORDER

The above petition has been filed seeking modification of the condition imposed in Crl.R.C.(MD)No.422 of 2025 dated 01.04.2025, wherein, this Court directed the petitioner to deposit the original Registration Certificate of the vehicle bearing Registration No.TN-63-AP-4134 before the learned Judicial Magistrate, Thirumayam.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) appearing for the respondent police.

The learned counsel appearing for the petitioner would submit that fitness certificate for the said vehicle got expired on 14.09.2025 and for renewing the fitness certificate, the submission of the original Registration Certificate is mandatory and that therefore, the petitioner may be given temporary custody of the original Registration Certificate only for the purpose of getting fitness certificate.

Considering the submission made by the learned counsel appearing for the petitioner, the learned Judicial Magistrate, Thirumayam, is directed to return the original Registration Certificate of the vehicle bearing Registration No.TN-63-AP-4134 to the petitioner for the purpose of getting fitness certificate. The petitioner is directed to 2/3

submit the original Registration Certificate before the learned Judicial Magistrate, Thirumayam, within a period of fifteen (15) days from the date on which the same is received from the concerned Court.

5. With the above directions, this Criminal Miscellaneous Petition is disposed of. 16-12-2025 CSM Note : Issue order copy on 17.12.2025 To 1.The Judicial Magistrate, Thirumayam.
