O R D E R

This Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the second respondent to conduct enquiry and dispose of petitioner's representation dated 16.09.2025.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

3. The learned counsel appearing for the petitioner would submit that the land in Survey No.216, measuring an extent of 0.90.50 hectares, originally belonged to the petitioner's grandfather, late Nachan Ambalam; that, since he had no direct legal heir, the patta devolved upon the five children of his younger brother, Pichan, including the petitioner's father; that the third respondent fraudulently executed a Settlement Deed in 1993, claiming to derive title from the petitioner's grandmother, Sathiyammal, without her knowledge and consent; that, upon becoming aware of the same, the petitioner's grandmother cancelled the Settlement Deed in 1995; Page No. 2 of 5

that, after her demise, the third respondent suppressing the facts managed to mutate the patta only in his name on 28.05.2016; that, therefore, the petitioner sent a representation to the second respondent seeking cancellation of the patta issued in the name of the third respondent; and that since the said representation did not elicit any response, this writ petition has been filed seeking a direction to consider and dispose of the said representation.

4. The learned Additional Government Pleader for the first to third respondents submits that the petitioner's representation will be considered on its merits and in accordance with law.

5. Recording the above submission, and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the second respondent to consider the petitioner's representation dated 16.09.2025 on its merits and in accordance with law and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order. The representation shall be considered and disposed of after conducting an enquiry. The second respondent is also directed to provide reasonable opportunity during such enquiry to the Page No. 3 of 5
