ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 379 IPC r/w Section 21(4) of Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.334 of 2022 on the file of the respondent police, in Spl.C.C.No.12 of 2025, on the file of the Principal District Judge, Theni, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner was allegedly found involved in illegal sand transportation and theft of minerals. Hence, after completion of investigation, final report was filed and the case is now pending for framing of charge against the accused. In this circumstances, since the petitioner has not regularly appeared before the trial Court, non bailable warrant was issued by the trial Court and the matter is posted for appearance of parties on 21.01.2026.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is 2/5

ready and willing to abide by any conditions which may be imposed by this Court. He has not wantonly absent before the trial Court. It is due to unavoidable circumstances. Hence, he seeks anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) opposed for grant of anticipatory bail to the petitioner. The petitioner has not regularly appeared before the trial Court.

5. Considering the facts and circumstances of the case, this Court this Court is directing the petitioner to surrender before the learned Principal District Judge, Theni and file a recall application seeking recall the non bailable warrant issued against him. On such application, the learned Judicial Magistrate shall consider the same in accordance with law on merits on the same day.
