PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus calling for the records relating to the impugned order of 3rd respondent in K.No.Vu.Mi.Po/E and Para/Oora/Ko/Pugar/A No.197-B/25-26 dated 22.10.2025 quash the same and 1/4
consequently direct the respondents 1 to 3 herein to disconnect the electricity service connection given in the name of 4th respondent to the joint properties of petitioner in S.No.196/4B in Vettuvakottai Thiruvonam Taluk, Thanjavur District.

ORDER
The present writ petition has been filed seeking to quash the order passed by the 3rd respondent wherein the request of the petitioner to disconnect the service connection standing in the name of the 4th respondent has been rejected.

A perusal of the records reveal that the petitioner and the 4th respondent are brothers and as on today, a suit for partition between them is pending in O.S.No.24 of 2018 on the file of the I Additional District and Sessions Court(PCR), Thanjavur. Therefore, it is clear that the 4th respondent is in possession of the property which is alleged to be a joint family property. In such circumstances, the respondents 1 to 3 cannot be directed to disconnect the service connection. After disposal of the suit, depending upon the outcome, the petitioner can revive his request.

3. With the above said observations, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is also closed. 16.12.2025 NCC : Yes/No Index : Yes/No Internet: Yes/No RJR 3/4
