For Petitioner : Mr.Muthuram R, in Crl.O.P(MD).No.22897 of 2025 For Petitioner :Mr.Dhilipan Pandian in Crl.O.P(MD).No.22907 of 2025 For Respondent : Mr.S.S.Manoj (in both Crl.O.Ps) Government Advocate (Crl.Side) For Intervenor : Mr.Jegadeesh Pandian (in both Crl.O.Ps) COMMON ORDER The petitioners/Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 189(2), 329(4), 126(2), 318(4), 351(2) of BNS and Sections 3 and 4 of Tamil Nadu Prohibition of Charging Exorbitant Interest Act, 2003, in Crime No.462 of 2025 on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that the defacto complainant had obtained a loan to the tune of Rs. 4,00,00,000/-, and thereafter, the petitioners, along with the other accused, threatened the de facto complainant for the repayment of Rs. 12,00,00,000/-. Hence, the complaint.

3. The learned counsel for the petitioners submitted that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. He further submitted that the petitioners are willing to abide by any conditions that may be imposed by this Court. Hence, he seeks anticipatory bail for the petitioners.
4. On the earlier occasion, after hearing the learned counsel for the petitioners and the learned Government Advocate (Crl.Side) and the learned Counsel appearing for the intervenor, this Court directed the petitioners to appear before the respondent police and co-operate with the investigation.
5. Today, when the matter is taken up for hearing, the learned Government Advocate (Crl.Side) submitted that the as per the direction of this Court, the petitioners regularly appearing before the respondent police and co-operated with the investigation.
6. Considering the facts and circumstances of the case and since the petitioner has complied with the conditions imposed by this Court, 3/6
the interim protection already granted by this Court is made absolute and this Court is inclined to grant anticipatory bail to the petitioners, with certain conditions.
7.Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, each for a like sum to the satisfaction of the learned District Munsif Cum Judicial Magistrate Court, Shencottai, Tenkasi, within a period of fifteen days from the date of receipt of a copy of this order and on further conditions that: [a]the petitioners and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhaar card or bank pass book to ensure their identity; [b] the petitioners shall report before the respondent police daily at 10.30 a.m., for a period of two weeks and thereafter, as and when required for interrogation.

[c]the petitioners shall not tamper with the evidence or witness either during investigation or trial. [d]the petitioners shall not abscond either during investigation or trial.
[e]On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioner is released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].
[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.
