ORDER

Seeking to transfer the maintenance case in M.C.No.6 of 2024 on the file of the learned Judicial Magistrate, Thirumangalam, this criminal original petition is filed.

2.Since no adverse order is going to be passed against the respondent, notice to him is dispensed with.

3.The learned counsel for the petitioner submitted that the petitioner herein is the wife of the respondent. She had earlier filed a maintenance case before the learned Judicial Magistrate, Thirumangalam, Madurai District, in view of her daughter's education at Thirumangalam and now that her daughter has completed her school education and she moved to Chennai and the petitioner has also moved to Chennai. The husband of the petitioner that is the respondent herein is already residing at Chennai. In view of the same, she seeks the indulgence of this Court to transfer the case in M.C.No.06 of 2024 from the file of learned Judicial Magistrate, Thirumangalam, to the file of the V Additional Family Court, Chennai.

4.Considering the fact that the criminal original petition seeking transfer of case from one Court to another is always being dealt with sympathetically in the case of women, more particularly, who are pursuing maintenance cases and even in this case, the petitioner is an estranged wife, who had sought for maintenance before the learned Judicial Magistrate, this Criminal Original Petition is allowed and the case in M.C.No.6 of 2024 is hereby transferred from 2/4

the file of the learned Judicial Magistrate, Thirumangalam, Madurai, to the file of V Additional Family Court, Chennai. Consequently, connected Miscellaneous Petition is closed.
