O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first respondent to dispose of the patta revision dated 19.09.2023, pending on the file of the first respondent in Proceedings No.G2/1374166/2023, within a time frame to be fixed by this Court.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself, dispensing with the notice to Page No. 2 of 7

the fourth to tenth respondents, as no adverse orders are proposed to be passed against them.

3. The grievance of the petitioner is that the subject properties, along with other properties, originally belonged to one Meyyan, who had two sons, namely Meyyan Poosari and Ariyan Poosari. The said Meyyan Poosari had two legal heirs, namely Villan Poosari and Sembayee. The said Ariyan Poosari had two sons, namely Ariyan Poosari @ Chinnakalai and Ponnan. The petitioner is one of the legal heirs of Villan Poosari.

4. The legal heirs of Meyyan Poosari filed a suit for partition against the legal heirs of Ariyan Poosari in O.S.No.108 of 1997 on the file of the learned Subordinate Judge, Sivagangai. The said suit was decreed on 23.01.1998 on the basis of a compromise memo, wherein the 'B' Schedule properties were allotted to the share of Villan Poosari. The survey numbers covered under the said 'B' Schedule properties are Survey Nos.101/4B3, 101/4A, 98/1, 98/2, 98/3, 100/1A, 100/3, 106/3, 106/4 and 89/1, falling under Patta Nos. 362 and 11 of Soorapatti Village, Melur Taluk, Madurai District.

As per the decree passed in the said suit and the subsequent registered Relinquishment Deed bearing Document No.2935 of 2020 dated 15.12.2020, the petitioner and his brother acquired absolute title to the said properties. However, the survey numbers mentioned in the said Relinquishment Deed are Survey Nos.101/4B3, 101/4A, 98/1A, 98/2, 100/1A, 100/3, 106/3, 106/4, 101/1B1B and 101/4B2. Despite the execution of the said registered Relinquishment Deed, the third respondent failed to issue patta in favour of the petitioner and his brother as mandated under Section 7 of the Tamil Nadu Patta Pass Book Act, 1983. Though the said properties are comprised in Patta Nos.362 and 11 of Soorapatti Village, Melur Taluk, Madurai District, relating to Survey Nos. 101/4A, 98/1A, 98/2, 100/1A, 100/3, 106/3 and 106/4, the third respondent has wrongly continued the patta as a joint patta.

6. Aggrieved by the same, the petitioner preferred a patta appeal before the second respondent on 09.06.2022 along with all necessary documents. The said appeal was taken on file as Na.Ka.No.4560/2022/A1 and was dismissed on 01.08.2023.

Aggrieved by the said order, the petitioner preferred a revision before the first respondent on 19.09.2023 within the prescribed time and the same was taken on file by the first respondent vide Proceedings No. G2/1374166/2023. However, till date, no orders have been passed therein. Therefore, the petitioner has been constrained to file the present Writ Petition.

8. The learned Special Government Pleader appearing for the first to third respondents, on instructions, would submit that the petitioner's revision would be disposed of by the first respondent within a period of twelve weeks.

Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the first respondent to conclude the enquiry on the petitioner's revision in Proceedings No.G2/1374166/2023 and dispose of the same on its merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. The first respondent is also directed to provide a reasonable opportunity of hearing to the Page No. 5 of 7

petitioner, the private respondents and any other interested parties who may be affected by such decision, before passing any order. There shall be no order as to costs.
