PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the second respondent to disconnect the EB Service connection No.361-015-595 and remove the electric pole erected in S.No.157, by considering the petitioner's representation dated 19.08.2025 within a time frame that may be fixed by this Court. ORDER

The present writ petition has been filed seeking a Mandamus directing the second respondent to disconnect the electricity service connection of the writ petitioner on the ground that such service connection is not required.

2. A perusal of the records reveals that the first respondent has addressed a communication to the Assistant Commissioner of National Highways, indicating that the writ petitioner's possession amounts to an encroachment in the national highways. It is also brought to the notice of this Court that a shop is being run by the tenant of the writ petitioner.

3. Under such circumstances, this Court is not inclined to issue a positive direction to the second respondent to disconnect the electricity service connection. However, as and when the encroachment is removed by the concerned authorities, the second respondent can disconnect the electricity service connection at that point of time.

4. With the above said observations, this writ petition stands dismissed. No costs.
