Prayer : Criminal Original Petition is filed under Section 528 of BNSS, 2023, to direct the learned Additional Sessions Judge (PCR), Tirunelveli, to accept the surrender of the petitioners in Crime No.582 of 2025 under Sections 189(2), 296(b), 351(3) BNS and 3(1)(r), 3(1)(s), 3(1)(s) and 3(2)(va) of SC/ST (POA) Act, on the file of the second respondent herein and dispose the bail application will be filed by the petitioners on the same day itself merits.

ORDER

This Criminal Original Petition has been filed to direct the learned Additional Sessions Judge (PCR), Tirunelveli, to accept the surrender of the petitioners in Crime No.582 of 2025 under Sections 189(2), 296(b), 351(3) BNS and 3(1)(r), 3(1)(s), 3(1)(s) and 3(2)(va) of SC/ST (POA) Act, on the file of the second respondent herein and 2/5

dispose the bail application will be filed by the petitioners on the same day itself merits.

2. Considering the nature of the relief sought for, notice to the 3rd respondent is dispensed with.

3. The case of the prosecution is that due to previous enmity between two groups, the petitioners and other accused persons went to the defacto complainant's steet with lethal weapons and threatened them with dire consequences. Based on these allegations, an FIR has been registered against the petitioners.

4. Heard the learned counsel on either side and carefully perused the materials available on record.

5. Considering the limited scope of the relief sought for, this Court hereby direct the learned Additional Sessions Judge (PCR), Tirunelveli, to issue prior notice to the de facto complainant and 3/5

thereafter to consider the bail application of the petitioners on the same day of their surrender before that Court in connection with Crime No. 582 of 2025 on the file of the 2nd respondent police.
