Prayer: This petition is filed under Section 483 of BNSS, 2023 r/w 528 of BNSS, 2023 to relax the condition to report before the 2nd respondent police daily at 10.30 a.m until further orders imposed upon the petitioner in Crl.A.(MD).No. 1171 of 2025 dated 07.11.2025.
ORDER
This petition is filed for relaxing the condition imposed in Crl.A.(MD).No. 1171 of 2025 dated 07.11.2025.
2. Initially, Cr.M.P.No.279 of 2025 was filed by the accused Nos. 1 and 2 before the learned Sessions Judge, Special Court for Trial of Cases under SC/ST (POA) Act, Theni, seeking bail. The said petition was dismissed by the Sessions Judge vide order dated 29.10.2025 as against which Crl.A(MD)No.1171 of 2025 was filed before this Court. This Court allowed the appeal vide its order dated 07.11.2025 and granted bail to the appellants.
3. While allowing the appeal, this Court imposed certain conditions in 7th paragraph of the said order. In condition No.7(b), the petitioner herein/first 2/5
appellant was ordered to appear before the second respondent police at 10.30 a.m until further orders. The present petition in Crl.M.P(MD)No.20164 of 2025 is filed by the petitioner to relax the abovesaid condition No.7(b).
4. The learned counsel for the petitioner submitted that the petitioner is a poor farmer and he is maintaining his family with the meagre income earned by him. The petitioner further states that he has a vehicle, which he purchased by raising a loan. Since he has to pay installments for the vehicle he was finding it difficult to comply with the condition 7(b) imposed by this Court and prayed that the said condition may be relaxed.
5. The learned Government Advocate (Crl.side) submits that the petitioner has complied with the condition imposed by this Court regularly except two days. He further submits that investigation has been completed and charge sheet has been filed.

7. In view of the averments made in the affidavit and considering the submissions made on either side, the condition No.7(b) already imposed on the petitioner by order dated 07.11.2025 in Crl.A(MD)No.1171 of 2025 is modified as follows:
''The petitioner shall appear before the trial court every Monday at 10.30 a.m till completion of trial''
