Prayer : Criminal Original Petition is filed under Section 528 of BNSS, 2023, to direct the respondents 1 and 2 to give necessary police protection for fencing the petitioner's lands measuring 0.45.5 Ares ie., 1 Acre comprised in S.No.120/1A situated at Palayam Village, Sanipatti, Kujiliamparai Taluk, Dindigul Ditrict, based on the petitioner's representation dated 25.08.2025 within the time stipulated by this Court.

ORDER
Seeking to direct the respondents 1 and 2 to give necessary police protection for fencing the petitioner's lands measuring 0.45.5 Ares ie., 1 Acre comprised in S.No.120/1A situated at Palayam Village, Sanipatti, Kujiliamparai Taluk, Dindigul Ditrict, based on the petitioner's representation dated 25.08.2025, this petition is filed. 2/6
2.The learned Government Advocate (Crl. Side) M.Sakthi Kumar, on instructions, submitted that it is not possible to provide protection to the petitioner for fencing their land as the matter is already sub-judice. The civil suit filed by the petitioner has been decided in his favor, against which the private parties have preferred an appeal before the jurisdictional appellate court. In view fo that, the police cannot interfere in a civil dispute.
3.However, the learned counsel for the petitioner submitted that now he is ready to restrict his relief to the extent that the aggressors may not hinder his agricultural activities.
4.Considering the pendency of civil suit, the second respondent police is directed to afford due protection to the petitioner, if he comes forward to file a fresh complaint seeking remedy to protect his agricultural land, at his expense.

5.With the above directions, this Criminal Original Petition is disposed of.
