give adequate and necessary for the peaceful opening of TASMAC Retails shop No.5484 at its newly sanctioned location at Vikkiramangalam Road, Eruvarpatti Village and Panchayat, Usilampatti taluk, Madurai situated at Madurai District and to executed teh order of the 1st respondent issued vide Na.Ka.No.069/SN 5484/2024/A4, dated 20.06.2025 within the stipulated time fixed by this Court.

O R D E R

This Writ Petition has been filed seeking a direction to the respondents 2 and 3 to provide adequate and necessary police protection for the peaceful opening of TASMAC Retail Shop No.5484 at its newly sanctioned location at Vikkiramangalam Road, Eruvarpatti Village and Panchayat, Usilampatti Taluk, Madurai District, and to implement the order of the 1st respondent issued vide Na.Ka.No.069/SN 5484/2024/A4, dated 20.06.2025, within the time stipulated by this Court. 2/5

2. Heard the learned counsel appearing for the petitioner.

The learned Government Advocate appearing for the respondents submitted that even though the first respondent has passed an order granting permission to the petitioner, the local people have raised objections to the opening of the new TASMAC shop at the said location. When objections are raised by the local public, the same ought to be considered by the competent authority. He further submitted that the respondents are not the competent authority to grant permission for opening the shop and that the District Collector, Madurai District being the competent authority, is required to consider the matter.

4. Considering the said submission, the District Collector, Madurai District, is suo motu impleaded as one of the parties in the present Writ Petition. The District Collector shall pass appropriate orders strictly after issuing notice to the objectors and after considering their objections. The issue shall be considered within a period of six weeks from the date of receipt of a copy of this order.

5. With the above observations, this Writ Petition is disposed of. No costs.
