This Writ Petition is filed seeking a Mandamus as against the respondents 1 & 2 to remove the encroachment made by the Respondents 3 to 6 at the HR & CE Department's temple land of Town Survey No.30 - extent 1750 sq.ft, situated at Thottakudi Anjaneyar Swami Thirukovil Bhuvanendirapuram Akraharam, Kumbakonam, Thanjavur District.
2. By consent, this Writ Petition is taken up for final disposal at the admission stage itself. Since no adverse order is going to be passed against the respondents 2 to 6, notice to them is dispensed with.
3. According to the petitioner, the respondents 3 to 6 were encroached the temple property. Therefore, the petitioner made a representation on 18.09.2024, seeking to remove the encroachment made by the respondents 3 to 6. Based on the said complaint, the first respondent by his proceedings dated 13.01.2025, directed the 2nd 2/4
respondent to take action and file a report. However, no action was taken by the 2nd respondent to remove the said encroachment. Hence, the petitioner has approached this Court by way of this Writ Petition.
4. The learned Special Government Pleader appearing for the first respondent, after getting instructions, would submit that if there is any encroachment, necessary action till be taken in accordance with law.
5. In view of the above, this Court directs the second respondent to consider the representation of the petitioner dated 18.09.2024 and take necessary action to remove the encroachment in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
6. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
