O R D E R
This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondent to consider the petitioner's representation dated 02.12.2025 and to return the additional amount of Rs. 11,95,276/- received from the petitioner, within a period to be stipulated by this Court.
2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.
3. The learned counsel appearing for the petitioner submits that the petitioner was allotted a shop by the respondent, the purchase price for which was fixed at Rs.5,64,000/-; that in respect of the recovery of the outstanding amount from the principal sum of Rs.5,64,000/-, this Court, in its order dated 28.09.2022 in W.A.(MD) No.1393 of 2011, ordered recovery of the principal amount together with simple interest at the rate of 16% per annum; that as per the instigation of the respondent, the petitioner has already paid a sum of Rs.26,13,046/-; that as per the order of this Court, the actual amount payable by the petitioner together with interest would come to Rs.14,19,770/-, but the petitioner paid in excess; Page No. 2 of 5
that, therefore, the petitioner sent a representation dated 02.12.2025 for the return of the additional amount of Rs.11,95,276/-; and that since the said representation did not evoke any response, the present writ petition has been filed.
4. The learned Special Government Pleader appearing for the respondent submits that the petitioner's representation will be considered on its own merits and in accordance with law.
5. Recording the above submission, and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the respondent to consider the petitioner's representation dated 02.12.2025 on its merits and in accordance with law and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order.
