PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus to issue direction directing the 1st respondent to issue passport to the petitioner by considering the petitioner passport application in File No.MD1065771644625 within the time frame fixed by this Court.

ORDER

The present writ petition has been filed seeking a mandamus directing the first respondent for issuance of the passport to the writ petitioner based upon his application in file No.MD1065771644625.

2. The learned Government Advocate(crl.side) appearing for the second respondent brought to the notice of the Court that the petitioner has been implicated in 7 criminal cases and out of the 7 cases, 4 of them ended in favour of the writ petitioner.

3. Cr.No.206 of 2018 on the file of the second respondent police got culminated in filing of a charge sheet in S.T.C.No.737 of 2018, and the petitioner was convicted and he was directed to pay a fine of Rs.300/-, which he has already made.

4. The petitioner is involved in another criminal case in Cr.No.252 of 2018 and Cr.No.281 of 2018 on the file of the second respondent. In both the cases, charge sheet is said to have been laid on 07.08.2018 and 07.07.2018 respectively. So far the same has not been taken on file by the learned Judicial Magistrate, Melur.

5. This Court in a judgment reported in 2014 (8) MLJ 61 has held that mere pendency of FIR is not a legal impediment for issuance of the passport.

6. In view of the above said facts, the first respondent is directed to consider the representation of the petitioner for issuance of the passport and pass orders within a period of 4(four) weeks from the date of receipt of a copy of this order.

7. With the above said observations, this writ petition stands disposed of. No costs.
