ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the respondents 1 to 4 to to consider the objection of the petitioner before conducting the survey in respect of land in Survey Nos.1016/3A and 1027/2, Ayyalur Village, Vedasandur Taluk, Dindigul District, based on the representation of the petitioner dated 06.12.2025.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. Since no adverse orders are going to be passed against the fifth respondent, notice to the fifth respondent is hereby dispensed with.

4. According to the petitioner, he is an interested and affected party in respect of the lands comprised in Survey Nos.1016/3A and 1027/2, Ayyalur Village, Vedasandur Taluk, Dindigul District. The petitioner has submitted a detailed objection dated 06.12.2025 to the respondents 1 to 4, requesting that his objections be duly considered before any survey is conducted in respect of the said lands. However, without considering the petitioner's objections, the respondents are proceeding to conduct the survey, which would adversely affect the petitioner's rights. Hence, the petitioner has approached this Court seeking a Writ of Mandamus, directing the respondents 1 to 4 to consider the petitioner's objections prior to conducting the survey.

The learned Government Advocate appearing for the respondents 1 to 4 submits that, pursuant to the orders dated 03.11.2025, passed in W.P.(MD)No. 31142 of 2025, which was filed by the fifth respondent herein seeking to survey the subject property, notices were issued to the petitioner herein and other interested persons in respect of the subject property. However, the learned Government Advocate for the respondents 1 to 4 fairly submits that the

petitioner's objections will be considered and appropriate orders will be passed on merits and in accordance with law.

Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the third respondent to consider the petitioner's representation / objections dated 06.12.2025 on merits and in accordance with law and to pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
