ORDER
The petitioner is a retired Block Health Supervisor. He was affected and diagnosed with COVID-19 and he took treatment in a 1/5
private hospital. Seeking reimbursement, the petitioner has approached the respondent. However, the same was not considered by the respondent and therefore, the petitioner has approached this Court by way of WP.(MD)No.25392 of 2023. This Court by its order dated 04.04.2024, has directed the respondent to consider the claim of the petitioner positively and pass necessary orders to sanction the eligible medical reimbursement as per the Tamil Nadu Medical Attendance Rules, within a period of three months from the date of receipt of copy of that order. The petitioner has filed this contempt petition that the order passed by this Court dated 04.04.2024 has not been complied with.
2.When this contempt petition is taken up for hearing today, the learned Special Government Pleader appearing for the respondent, by referring to the proceedings of the Treasuries and Accounts Department dated 07.01.2026, submits that the Director of Treasuries and Accounts (FAC) has already passed an order directing the Chief Manager, United India Insurance Co.Ltd., to pay a sum of Rs.13,000/- as enhanced amount to the petitioner for the medical expenditure incurred by him. According to the learned Special Government 2/5
Pleader, the petitioner has already been paid a sum of Rs.1,44,500/- and as per direction of this Court, it has been recalculated and an additional amount has been directed to be paid to the petitioner by the above said proceedings dated 07.01.2026.
3.The learned counsel for the petitioner has raised serious objection to the amount decided in the proceedings dated 07.01.2026 that it is not in accordance with the orders passed by this Court. 4.This Court has considered the submissions made on either side and perused the available records.
5.This Court has passed an order directing the respondent to consider the claim of the petitioner and pass necessary orders to sanction the eligible medical reimbursement as per the Tamil Nadu Medical Attendance Rules. As per directions of this Court, the respondent has also recalculated and passed an order directing the United India Insurance Company to pay an amount in addition to the amount which has already been paid by the Insurance Company. Therefore, this Court is not inclined to entertain this contempt petition. 3/5
In the event, if the petitioner is aggrieved that the amount arrived is not adequate and it is not in accordance with the Tamil Nadu Medical Attendance Rules, it is always open to the petitioner to file a fresh petition. The respondent shall ensure that the amount as ordered in the proceedings dated 07.01.2026 is paid to the petitioner, within a period of two weeks from the date of receipt of a copy of this order.
