This Writ Petition is filed seeking a Mandamus as against the respondents to consider the petitioner's representation dated 23.08.2025 and to revoke the Certificate of Registration of clinical establishment Registration No.TANJALL20210028699 in the name of PK Clinic @ PK Hospital in Thanjavur District.
2. By consent, this Writ Petition is taken up for final disposal.
3. According to the petitioner, the petitioner and his two brothers and one sister were started partnership firm in the year 1991 in the name and style of P.K.Clinic @ PK Hospital and the said partnership firm doing its business of running hospital and medical shop in the subject property. While being so, except petitioner, all other partners of the firm were died. After death of all the partners, no one legal heirs were included in the firm as partners. Hence, the fact remains that the partnership firm has come to an end. Despite the fact that the partnership firm came to an end, the hospital is still running by the legal heir of the petitioner's brother, which is unlawful. Therefore, the petitioner made a 2/4
representation on 23.08.2025, seeking to revoke the permission for running the hospital. Since no action was taken, the petitioner has come forward to file this Writ Petition.
4. The learned Special Government Pleader appearing for the respondents, after getting instructions, would submit that the representation of the petitioner dated 23.08.2025 would be considered in accordance with law.
5. In view of the same, without expressing any opinion on the merits of the matter, this Court directs the second respondent to consider and pass orders on the representation of the petitioner dated 23.08.2025, on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
6. With the above directions, the Writ Petition stands disposed of. There shall be no order as to costs. 16.12.2025 vsm 3/4
