O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first to third respondents to recover the amount from the fourth respondent, in the light of the order passed in W.C.No.28 of 2017 on the file of the third respondent herein, dated 22.09.2022, under the Revenue Recovery Act, 1890 and to disburse the same to the claimants at the earliest.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

3. The learned counsel for the petitioner would submit that though an award dated 22.09.2022 was passed by the third respondent in W.C. No.28 of 2017 awarding a compensation of Rs.6,17,360/- along with interest at the rate of 12% per annum, for the death of the petitioner's father in an electrocution accident on 07.10.2016, as against the fourth Page No. 2 of 5

respondent, the fourth respondent has not come forward to deposit the said amount. He would further submit that despite the petitioner having made several attempts by submitting representations to the first to third respondents for recovery of the said amount under the Revenue Recovery Act, 1890, no recovery proceedings have been initiated against the fourth respondent.

The learned Additional Government Pleader appearing for the first and second respondents, on instructions, would submit that the process for recovery would be initiated by the second respondent, Tahsildar, immediately based on the petitioner's representation and would seek reasonable time for completion of the proceedings.

5. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the second respondent, the Tahsildar, to initiate the recovery proceedings forthwith, as undertaken by the learned Additional Government Pleader and to complete the same within a period of six months from the date of receipt of a copy of this order. It is needless to state that before passing any order, the second respondent shall provide a Page No. 3 of 5

reasonable opportunity of hearing to the petitioner. There shall be no order as to costs.
