PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned rejection order in Application No.TN-720250430280 dated 30.04.2025, quash the same as illegal and arbitrary, and consequently direct the first respondent to issue a legal heir certificate that the petitioner's mother namely Muniyammal is the only legal heir of her father Periyampillai Servai, within the time stipulated by this Court.

ORDER
The present writ petition has been filed seeking to quash the order passed by the first respondent herein wherein the request of the petitioner for issuance of the legal heir certificate has been rejected on the ground that the deceased person had two wives.

According to the learned counsel appearing for the writ petitioner, her deceased grandfather, namely, Periyampillaiservai had two wives, namely, Petchiammal who is the legally wedded first wife and one Karuppayee. According to him, the second wife, namely, Karuppayee had died issueless. As on today, there is no rival claim at all. The petitioner claims to be the grand daughter of the Petchiyammal.
3. In view of the above said facts, the order impugned in the writ petition is hereby set aside and the matter is remanded back to the file of the first respondent herein. The first respondent is directed to verify whether the second wife, namely, Karuppayee, had passed away and in case, if she had left any legal 2/4
heirs, their names may also be incorporated and legal heir certificate may be issued to the petitioner.
