ORDER

This petition has been filed to relax the condition imposed in Crl.MP(MD)No.2768 of 2024 in Crl.A(MD)No.915 of 2023 dated 05.03.2024.

2.This Court while suspending the sentence imposed the following conditions.

i) The petitioners shall execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Additional District and Sessions Judge (Fast Track Court), Kumbakonam.

ii) The petitioners shall appear and sign before the learned Additional District and Sessions Judge (Fast Track Court), Kumbakonam, on the 1st and 15th working day of every English calender month at 10.30 a.m., until further orders. iii) In case, if the petitioners are unable to appear before the Court on the 1st and 15th working day of a month, they shall appear on the next working day.

iv) The petitioners shall furnish their residential address and mobile numbers to the Trial Court ie., learned Additional District and Sessions Judge (Fast Track Court), Kumbakonam 3.The petitioners in their affidavit stated that they are agricultural coolie and are finding it very difficult to comply with Condition No.ii of 2/4

the aforesaid order. The petitioners further stated that they are unable to perform their agricultural duties in time due to the said condition. 4.The learned Government Advocate (Crl.Side) submitted that the petitioner has complied with the order passed by this court on 05.03.2024 without any default.

5.In view of the averments made in this petition, this Court is inclined to relax the Condition No.ii. Accordingly, the petition is allowed. The petitioners shall appear before the learned Additional District and Sessions Judge (Fast Track Court), Kumbakonam once in a month i.e., on the first working day of every English Calendar month at 10.30 a.m., until further orders.
