This petition is filed for issuance of Writ of Mandamus, directing the 2nd respondent to implementing the order of the learned Judicial Magistrate, Sankarankovil in Crl.M.P.No.169 of 2025 by registering the FIR in accordance with law within a stipulated time fixed by this Court.

ORDER

This petition has been filed seeking a direction to the second respondent to implement the order passed by the learned Judicial Magistrate, Sankarankovil, in Crl.M.P.No.169 of 2025 by registering an FIR in accordance with law, within a time frame to be fixed by this Court.

2. The learned Government Advocate would submit that based on the order passed by the learned Magistrate, the respondents conducted an enquiry and the same was closed. Therefore, there is no question of reopening the enquiry.

3. The learned counsel appearing for the petitioner would vehemently submit that the rival claimant has filed a suit in O.S.No.220 of 2024 on the file of the Sub Court, Sankarankovil, claiming a 1/9th share in certain properties comprised in specific survey numbers. However, the rival claimants have sold the petitioner's property by executing several sale deeds. The said sale deeds do not disclose the share allegedly belonging to the petitioner and are totally silent with regard to the claim of 1/9th share. Therefore, the petitioner contends that the rival claimants have cheated him.

4. In view of the fact that the respondents have already closed the enquiry, it

may not be appropriate to direct the respondents to reopen the same. Hence, liberty is granted to the petitioner to submit a fresh representation to the respondents. On receipt of such representation, the respondents shall consider the same and, if any cognizable offence is made out, proceed further in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.
