PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of MANDAMUS directing the 1st respondent to Re-issue the Passport based on the petitioner's application in File No.TR2075005632125, dated 01.05.2025 by considering the petitioner's representation dated 13.11.2025.

ORDER
The present writ petition has been filed seeking a mandamus as against the first respondent to reissue of the passport based upon his application dated 01.05.2025 and his representation dated 13.11.2025.
2. The learned Government Advocate(crl.side) appearing for the 2nd respondent brought to the notice of the Court that the petitioner has been implicated in a criminal case in Cr.No.220 of 2021 on the file of the Malaiyur Police Station, Pudukottai District for alleged offences of sand theft. She further submits that though charge sheet has been laid before the learned Judicial Magistrate Court, Alangudi on 25.01.2022, so far it has not been taken on file.
3. This Court in a judgment reported in 2014 (8) MLJ 61 has held that mere pendency of FIR would not be a legal impediment for issuance of passport.

4. In view of the above said facts, the first respondent is directed to consider the request of the petitioner and pass orders within a period of four weeks from the date of receipt of a copy of this order.
5. With the above said observations, this writ petition stands disposed of. No costs.
