O R D E R

1. The petitioner is before this Court seeking issuance of a Writ of Mandamus forbearing the first respondent from granting an electricity service connection in favour of the second respondent in respect of the property in Survey No.241/13, Viralimalai Village and Taluk, Pudukottai District, pending disposal of the proceedings before the Revenue Divisional Officer, Illupur.

2. The petitioner claims to be the owner of the said property. It is stated that the patta issued in favour of the petitioner was subsequently cancelled, and therefore the petitioner has preferred an appeal before the Revenue Divisional Officer, which is presently pending. In the meantime, the second respondent has applied for electricity service connection to 2/5

the said property. Since objections were raised by the petitioner, the first respondent has not yet provided the electricity connection. The dispute regarding the validity of the cancellation of patta is pending before the competent authority, and this Court cannot adjudicate upon the same in the present proceedings. As on date, there is no order restraining the second respondent from seeking an electricity connection. In such circumstances, the second respondent cannot be denied electricity service connection merely on the basis of the pending dispute.

In view of the above, the first respondent is directed to provide electricity service connection to the property in question, subject to the final outcome of the appeal pending before the Revenue Divisional Officer. In the event the petitioner succeeds in the said proceedings, the first respondent shall take appropriate steps, including disconnection of the electricity service connection granted to the second respondent. 3/5

4. With the above directions, this Writ Petition stands disposed of. No costs. Consequently, the connected miscellaneous petitions are closed.
