PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the first respondent to issue passport to the petitioner by considering the passport application in File No.MD1065574892025, dated 02.09.2025 within the period fixed by this Court.

O R D E R
The present writ petition has been filed seeking a Mandamus directing the first respondent to consider the request of the petitioner for issuance of passport based upon his application dated 02.09.2025.
2. The learned Government Advocate (Criminal Side) appearing for the respondents 3 and 4 brought to the notice of this Court that the petitioner has been implicated in 10 criminal cases. Out of 10 cases, 7 cases have ended in favour of the writ petitioner. As far as Crime No.1851 of 2011 on the file of the third respondent is concerned, though charge sheet was laid on 2/6
29.07.2022 before the learned Judicial Magistrate No.V, Madurai, so far it has not been taken on file. As far as Crime No.155 of 2011 on the file of the fourth respondent police is concerned, charge sheet was laid on 25.04.2011 before the learned Judicial Magistrate, Paramakudi and the same has not yet been taken on file.

It is further submitted that as far as Crime No.237 of 2023 on the file of the fourth respondent is concerned, it has culminated into filing of a charge sheet and it was taken on file in S.C.No.130 of 2024 on the file of the learned Additional District and Session Judge, Paramakudi, and the same is pending trial.

In view of the above said facts it is clear that as far as Crime Nos. 1851 of 2011 and 155 of 2011 are concerned, though charge sheets have been laid long back, due to the memo of objection raised by the concerned Court, they have not been taken on file. So far, the officials have not taken any steps to represent the same, after rectifying the defects. 3/6

In view of the above said submissions, the petitioner is directed to approach the learned Additional District and Sessions Judge, Paramakudi in S.C.No.130 of 2024 seeking permission of the Court to go abroad. In case, if any such application is filed, the same shall be disposed of within a period of four weeks. Based upon the order passed by the learned Additional District and Sessions Judge, Paramakudi, the first respondent is directed to proceed in accordance with law.
6. With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs.
