ORDER

Seeking a direction to the respondents 1 and 2 to give adequate police protection for the life and limb of the petitioner and his family members by 1/5

considering the petitioner's representation dated 27.11.2025, this petition is filed.

2.Considering the limited scope of the relief sought for, notice to the third respondent is dispensed with.

3.The learned counsel appearing for the petitioner submitted that the third respondent is none other than the wife of the petitioner's brother. He further submitted that the petitioner and the third respondent are co-owners of the family property comprised in S.No.300/16 situated at Thiruvadhur Village, Melur Taluk, Madurai District measuring an extent of 1 acre 80 cent. After the demise of their brother, the petitioner, his brother and sister were jointly enjoying the said property. In the meanwhile, both his brother and sister passed away, their legal heirs along with the petitioner are continuing to enjoy the property. Nevertheless, the petitioner is currently prevented by the 3rd respondent denying access to the said property. Hence, the petitioner and his sister's daughter have filed a suit in O.S.No.635 of 2024 on the file of the Vth Additional District and Sessions Judge, Madurai, seeking partition. After filing the suit, the third respondent is continuously harassing the petitioner and his family members. Hence, the present petition is filed. 2/5

4.The learned Government Advocate (Crl. Side) Mr.M.Sakthi Kumar, on instructions, submitted that when the partition suit is pending, the respondent Police cannot meddle with a civil matter. However, as far as the representation dated 27.11.2025 mentioned by the learned counsel for the petitioner is concerned, the same was sent to the Superintendent of Police through post by the petitioner and the second respondent has not received the same so far.

5. Heard the learned counsels on either side and carefully perused the materials available on record.

6.Even according to the said representation dated 27.11.2025, the petitioner is a practicing Doctor, who had been residing at Chennai. Considering the fact that the dispute involved in the matter is civil in nature, this Court is of the considered opinion that the parties can work out their respective remedies before the pending civil suit. However, if at all, any life threat is caused to the petitioner at the time of visiting the joint property, they can directly lodge a complaint before the respondent police. On receipt of any such complaint from the petitioner, the second respondent police is directed to deal with the same in accordance with the law. 3/5
