PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, to issue a issue a Writ of Mandamus directing the respondents 1 to 3 to remove the encroachment made by the respondents 4 to 10 in S.Nos. 301, 302, 304, 306, 307, 311, 312, 313, 314 and 315 situated at Periyammapatty Village, Palani Taluk, Dindigul District based on the representation dated 13.11.2025 within a time frame. ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) The petitioners has filed this Writ Petition seeking a direction to respondents 1 to 3 to remove the encroachment made by the respondents 4 to 10 in S.Nos.301, 302, 304, 306, 307, 311, 312, 313, 314 and 315 situated at Periyammapatty Village, Palani Taluk, Dindigul District, based on the representation dated 13.11.2025, within a time frame.

2. According to the petitioner, respondents 4 to 10 have encroached upon the pathway in the subject survey numbers and 2/6

converted it into agricultural land. Therefore, the petitioner filed a Writ Petition in W.P. (MD) No. 23680 of 2022, and this Court, by order dated 14.10.2022, directed respondents 1 to 3 to take action to identify the encroachments and remove the same. As there was no compliance with the order passed by this Court, the petitioner submitted a representation on 13.11.2025. However, no action was taken by the respondents till date. Hence, the petitioner has filed the present Writ Petition.

3. The learned counsel appearing for the respondents 4 to 10 would submit that a notice under Section 7 of the Tamil Nadu Land Encroachment Act, 1905 has been issued to them and they have submitted their explanation to the said notice.

4. In view of the above and taking note of the fact that notice under Section 7 of the Tamil Nadu Land Encroachment Act, 1905 has already been issued to respondents 4 to 10 and that they have also submitted their explanation to the said notice, this Court directs respondents 1 to 3 to consider the said explanation and thereafter complete the process by issuing notice under Section 6 of the Tamil Nadu Land Encroachment Act, 1905 and proceed in accordance with law. aforesaid exercise shall be completed within a period of three months from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
