PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the impunged Charge Memorandum issued by the second respondent vide Na.Ka.No. 2666926/2024/RD-5 dated 27.01.2025 and quash the same as illegal, and further direct the 2nd and 3rd respondent to confer all the promotional and Monetary benefits within a stipulated time.

Challenging the charge memo, dated 27.01.2025, issued as against this petitioner, she has approached this Court. 2.The learned counsel appearing for the petitioner submits that the petitioner is working as a Rural Welfare Officer -I in Kottanpatti Panchayat Union Office, Melur Taluk, Madurai. While so, she was issued with a charge memo, vide Na.Ka.No. 2666926/2024/RD-5, dated 27.01.2025, under 17(b) of Tamil Nadu 2/6

Civil Servants (Discipline and Appeal) Rules, for availing leave for 62 days. The petitioner has submitted her detailed explanation, citing her health issues, however, without considering the same, the respondents have proceeded with the enquiry, by appointing Mr.Muruganantham, APO, DRDA, Madurai as an enquiry officer. The petitioner has raised an objection to change the enquiry officer and the enquiry officer was also changed, by order, dated 09.06.2025. In the meantime, the petitioner was referred to Medical Board at Government Homeopathy Medical College, Thirumangalam, wherein, the Board has approved the petitioner's leave period. Based on the report of the Medical Board, the District Collector, Madurai/the second respondent has ratified and regularized the leave period.

According to the petitioner, she has attended the enquiry properly and submitted her explanation along with the Medical Board report. However, the enquiry proceedings are kept pending without any progress. The grievance of the petitioner is that due to pendency of the enquiry, her promotional opportunity has been denied.

Mr.C.Venkatesh Kumar, learned Special Government Pleader takes notice for the respondents and submits that the petitioner has made a request to change the enquiry officer that was also considered and a woman enquiry officer was appointed. The woman enquiry officer has also completed her enquiry, however yet to submit her report. Once the report of the enquiry officer is received, they would conclude the enquiry.

4.It is reported that the enquiry has been concluded and the report alone is yet to be filed. Considering the stage of the enquiry, this Court is not inclined to interfere at this stage. Considering the submission of the petitioner that due to pendency of enquiry, her promotional opportunity has been denied, this Court directs the Disciplinary authority to conclude the disciplinary proceedings as expeditiously as possible, preferably, within a period of three months from the date of receipt of a copy of this order. 4/6

5.With the above direction, this writ petition is disposed of. No costs. Consequently, connected Miscellaneous Petition is closed.
