Prayer: Writ Petition filed under Article 226 of Constitution of India, praying to issue a Writ of Mandamus, directing the 2nd respondent to cancel the illegal objection raised against its registration and consider to register the gift deed presented by the petitioner based on his representation dated 08.12.2025.

ORDER

This Writ Petition has been filed to direct the second respondent to cancel the illegal objection and consider the registration of document presented by the petitioner, based on the petitioner's representation dated 08.12.2025.

2. Mr.M.Lingadurai, learned Special Government Pleader takes notice for the respondents.

3. By consent, this Writ Petition is taken up for final disposal at the admission stage itself.

The learned counsel appearing for the petitioner would submit that the mother of the petitioner being absolute owner of the subject property executed a gift deed dated 19.08.2013 in favour of the petitioner. Now, the petitioner intends to sell the property. However, when the petitioner presented a sale deed to the second respondent for registration, the second respondent refused to register the same by citing an objection that was filed in the year 2006. Hence, the present petition. 2/5

5. The learned Special Government Pleader appearing for the respondents would submit that in the event any sale deed is presented by the petitioner, the same will be considered for registration in accordance with law.

6. I have given due consideration to the submissions made on either sides.

In the present case, the petitioner's mother being an absolute owner of the subject property, executed a gift deed dated 19.08.2013, in favour of the petitioner and now, the petitioner is intend to sell the subject property. The objection was made as early as in the year 2006. Such being the case, unless and otherwise any interim order is in force barring subsequent registration of document in respect of the subject property, the second respondent cannot refuse to register the sale deed presented by the petitioner solely based on the objection. Under such circumstances, the petitioner is directed to present the sale deed before the second respondent and upon such presentation, the second respondent shall issue due notice to the objector as well as the petitioner, conduct enquiry, and thereafter, proceed with the registration of the sale deed, if it is in accordance with law. 3/5
