To grant an order of interim suspension of sentence imposed in S.C. No. 257 of 2016 dated 04.03.2025, on the file of the learned V Additional District and Sessions Judge, Madurai and enlarge the petitioner on bail pending the disposal of the main appeal

ORDER

(Order of the Court was made by the Hon'ble N.Anand Venkatesh J.) This petition has been filed seeking for interim suspension of sentence imposed on the petitioner in S.C. No. 257 of 2016 dated 04.03.2025, on the file of the learned V Additional District and Sessions Judge, Madurai and to enlarge the petitioner on bail pending the disposal of the main appeal.

2. Heard the learned counsel on either side.

3. We find that there were totally six witnesses examined on the side of the prosecution as eye-witnesses to the incident.

4. The main ground that was urged by the learned counsel appearing for the petitioner is that the place of occurrence itself is doubt and there is contradiction.

5. After carefully considering the submissions made on either side and the materials available on record, we are not inclined to suspend the sentence.

6. Accordingly, this petition stands dismissed. Registry is directed to prepare the paper book and include the appeal in the advance list. (N.ANAND VENKATESH J.)
