This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first respondent to dispose of the petitioner's application dated 01.11.2025 relating to the cancellation of patta issued in respect of the properties comprised in Survey Nos.255/5A and 255/5C, measuring an extent of 7 Ares and 16.5 Ares respectively, situated at Thummakkundu Village, Usilampatti Taluk, Madurai District, within a time frame to be fixed by this Court.

With the consent of the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the official respondents, this Writ Petition is taken up for final disposal at the admission stage itself, dispensing with notice to the private respondents, as no adverse orders are proposed to be passed against them.

The learned counsel appearing for the petitioner would submit that the subject lands in Survey Nos.255/5A and 255/5C, measuring an extent of 7 ares and 16.5 ares respectively, belong to the tenth respondent, who acquired the same by way of succession; that under the General Power of Attorney dated 12.09.2008, the petitioner had signed as a surety, based on the request of the third respondent, without knowing the real fact that the said document was a forged power deed and that the third respondent had no right over the said property; that based on the said forged deed, the third respondent subdivided the property and sold the same to third parties for valuable consideration, without the knowledge of the petitioner as well as the tenth respondent and obtained patta; that after the same came to the knowledge of the petitioner through the tenth respondent, the petitioner filed an application before the first respondent on 06.02.2024 seeking cancellation of patta; that the tenth respondent also Page No. 3 of 6
filed an application seeking cancellation of patta, which was taken on file as Na.Ka.No.160/A3/2024; that since the petitioner's application was not considered, the petitioner sent representations dated 08.09.2025 and 03.11.2025; that both the representations were registered as O.Mu.No. 4688/2025/A3 and O.Mu.No.5972/2025/A3; that however, the first respondent has not taken any steps to consider the petitioner's application and the representations; and that therefore, the petitioner was constrained to file the present Writ Petition.
4. The learned Additional Government Pleader appearing for the first and second respondents would submit that the petitioner's application/representation dated 01.11.2025 would be considered and appropriate orders would be passed within a period of twelve weeks.

Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the first respondent to consider the petitioner's application/representation dated 01.11.2025 on its merits and in accordance with law and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order. application/representation shall be considered and disposed of after conducting an enquiry. The first respondent is also directed to provide a reasonable opportunity during such enquiry to the petitioner, the private respondents and any other interested parties who may be affected by the decision.
