ORDER
This writ petition has been filed seeking a Mandamus, directing to the 1st respondent to disburse the pension arrears of Rs.7,87,212/- for the period from October 2009 to June 2017 and further sum of Rs.99,270/- for the subsequent period till the date of disbursement of pension in the year 2017 along with interest.
2. The petitioner, who served as a Conductor in the respondent Transport Corporation, was dismissed from service, pursuant to a disciplinary proceedings initiated in the year 1992. However, the order of dismissal was set aside by the Labour Court, Tirunelveli, in I.D.No. 163 of 1993 dated 31.05.1996 and a direction was issued for 2/5
reinstatement of the petitioner into service with full backwages. The issue went upto the Hon'ble Supreme Court and a Special Leave Petition filed by the Management was dismissed by the Hon'ble Supreme Court, in SLP No.9912 of 2008, dated 09.02.2010. The Hon'ble Supreme Court, while dismissing the Special Leave Petition filed by the Management, has modified the relief granted by the Labour Court that the petitioner is entitled for 50% of the backwages instead of 100% as recorded by the Labour Court. Even thereafter, the petitioner was not paid with the backwages. The petitioner has also made a representation to the respondents requesting to pay the backwages. Since the petitioner's representation has not been considered, a writ petition in W.P.(MD)No. 13051 of 2019 has been filed before this Court. This Court, by order dated 19.06.2019, disposed of the writ petition with a direction to the Transport Corporation to consider the petitioner's representation on merits. Even thereafter, it appears that the respondent Corporation has not passed any orders.
3. In view of the above, this writ petition is allowed with a direction to the respondents to pay the arrears of backwages due to the 3/5
petitioner as directed by the Hon'ble Supreme Court in SLP No.9912 of 2008, dated 09.02.2010, within a period of six weeks from the date of receipt of a copy of this order. No costs.
