ORDER

This writ petition is filed seeking a direction to the first respondent to consider the representation dated 12.11.2025 thereby preventing the private respondents 3 and 4 herein from continuing the office of Paramakudi Hyradul Jamalia Keela Muslim Sangam (hereinafter referred to as 'Sangam') in the election conducted for the year 2025-2028 till the disposal of the appeal pending before the 1st respondent.

2. By consent of both parties, this writ petition is disposed at the stage of admission itself. Since no adverse order is proposed to be passed in this writ petition, notice to the respondents 3 and 4 is dispensed with.

3. The petitioner alleges that a new set of office bearers has been appointed recently and that they are taking decisions arbitrarily, based on 2/5

their own whims and fancies. In view of the same, the petitioner submitted a representation dated 12.11.2025, seeking permission for the previous office bearers and the President to manage and take care of the affairs of the Sangam.

4. The learned counsel appearing for the respondents 1 and 2 would submit that a new set of office bearers was appointed on 24.08.2025 pursuant to a duly conducted election. It is further submitted that, without any documentary proof and based solely on apprehension, the petitioner filed the said representation seeking to prevent the newly elected office bearers from continuing in office and managing the affairs of the Sangam. However, the representation of the petitioner cannot be considered, as the new set of office bearers was elected only after the conduct of a proper election, and therefore, they cannot be suspended by permitting the previous office bearers and the President to manage the affairs of the Sangam.

5. I find force in the submission of the learned counsel appearing for the respondents.

6. In the present case, the members of the Sangam elected a new set of office bearers after the conduct of a proper election on 24.08.2025. The petitioner is also one of the members of the Sangam. However, being dissatisfied with the newly elected set of office bearers, the petitioner submitted a representation to the Superintendent of Waqf.

7. There is no dispute that the present set of office bearers was elected strictly in accordance with the applicable Rules and Regulations. That being so, the newly elected office bearers cannot be restricted or suspended merely on the basis of the petitioner's representation. In view of the same, I do not find any merit in the representation, and this Court is not inclined to issue any writ of mandamus directing the respondents to pass orders on the petitioner's representation. Accordingly, the writ petition stands dismissed. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed. 18.12.2025 Index : Yes/No sm 4/5
