PRAYER: Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus to direct the respondent no.3 to grant 3 days ordinary leave or emergence leave to the petitioner under the Tamilnadu Suspension of Sentence Rules, 1982 for enabling the petitioner for participation in the book releasing ceremony which was written by the petitioner in the name of "Oru Thookku Kaithiyin Vakkumoolam' on the basis of the petitioner's representation dated 21.11.2025 in accordance with law within the time stipulated by this Court.

O R D E R

(Order of the Court was made by G.K. ILANTHIRAIYAN,J.) This Writ Petition has been filed to direct the respondent no.3 to grant 3 days ordinary leave or emergence leave to the petitioner under the Tamilnadu Suspension of Sentence Rules, 1982 to enable the petitioner to participate in the book releasing ceremony, which book was written by the petitioner in the name of "Oru Thookku Kaithiyin Vakkumoolam' on the basis of the petitioner's representation dated 21.11.2025.

2. The petitioner is the life convict in S.C.No.392 of 1997 on the file of the Principal Sessions Judge, Tirunelveli and the sentence was confirmed by the Honourable Supreme Court as well. The petitioner is languishing in prison for the past 31 years. While being so, the petitioner has applied for leave of three days to visit his mother at Kanyakumari and to attend his book release function scheduled to be held on 20.12.2025. The representation was considered by the third respondent and the petitioner was granted three days emergency leave to visit his mother at Kanyakumari District. However, the representation submitted by the petitioner seeking permission to attend the book release function was not considered. Pending that representation, the petitioner was transferred from Central Prison, Trichy to Central Prison, Vellore. The petitioner has made a fresh representation dated 12.12.2025 to the Deputy Inspector General of Prisons, Vellore seeking permission to attend the book release function. It was considered and rejected by order dated 16.12.2025.

3. The learned counsel appearing for the petitioner also produced the invitation of the function before this Court and perusal of the same

reveals that the book release function is scheduled to be held at Chennai on 20.12.2025. The petitioner has also restricted his movement only to Chennai to attend book release function.

4. In view of the above, we are inclined to grant one day emergency leave to the petitioner on 20.12.2025 with escort. Therefore, (i) The Deputy Inspector General of Prisons, Vellore is directed to grant one day emergency leave to the petitioner, namely, Selvam, S/o.Chinnadurai on 20.12.2025.

(ii) The convict prisoner shall be released from the prison at 6.00 a.m on 20.12.2025 and he shall return back to the prison at 12.00 midnight on the same day.

(iii) Necessary escort shall be provided to accompany the convict prisoner.

(iv) The petitioner shall produce all necessary documents, along with a copy of this order, before the jail authorities.

5. With the above directions, this Writ Petition Criminal is disposed of. The petitioner is at liberty to make a fresh representation before the concerned Jail Authorities seeking emergency leave to visit his mother at Kanyakumari District. No costs.
