O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the second respondent to dispose of the petitioner's application dated 22.01.2025 within the time stipulated by this Court.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

The case of the petitioner is that the property bearing Old Survey No.125/1A, New Survey No.296/20, Old Door No.6/96 and New Door No.1339, situated at Senior Street, Kurichimalai, 63-Thirumangalakudi, Thiruvidaimarudur Taluk, Thanjavur District, belongs to the petitioner, which was settled in his favour by his father by way of a registered Will dated 18.03.1981. The petitioner and his family members have been in peaceful possession and enjoyment of the said property for the past four decades, without any hindrance.

4. One Vasuki claimed ownership of the property through a Settlement Deed dated 07.06.2016, allegedly executed by her husband, Sivashanmugam. The said Vasuki thereafter executed a Power of Attorney Page No. 2 of 6

dated 13.03.2019 in favour of one Selvarajan, who in turn sold the property to one Valarmathi under a Sale Deed dated 12.12.2024.

When the petitioner came to know that the name of Vasuki's husband had been wrongly included in UDR Joint Patta No.788, the petitioner submitted an application dated 22.01.2025 before the second respondent seeking correction and cancellation of the erroneous UDR Joint Patta. During the pendency of the enquiry, the said Vasuki filed a suit in O.S.No.120 of 2025 on the file of the Additional Sub Court, Kumbakonam, with the sole intention of delaying the statutory proceedings before the second respondent, Revenue Divisional Officer.

6. The second respondent has failed to consider the petitioner's application till date. Therefore, the petitioner was constrained to file the present Writ Petition.

7. The learned Special Government Pleader appearing for the respondents would submit that the petitioner's application dated 22.01.2025 would be considered and appropriate orders would be passed by the second respondent within a period of twelve weeks. Page No. 3 of 6

Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the second respondent to consider the petitioner's application dated 22.01.2025 on its merits and in accordance with law and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order. The application dated 22.01.2025 shall be considered and disposed of after conducting an enquiry. The second respondent is also directed to provide a reasonable opportunity of hearing during such enquiry to the petitioner, the said Vasuki, Sivashanmugam, the subsequent purchasers and any other interested parties who may be affected by the decision. In the event of any rival claims, the parties are at liberty to pursue their remedies before the Civil Court. There shall be no order as to costs.
