ORDER : The Court made the following order :- 1/4

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 5(l), 5(n)(i)(ii) r/w 6 of POCSO Act and Section 450 of IPC, in Crime No.12 of 2021 on the file of the respondent police, seeks anticipatory bail. The charge sheet was taken on file in Spl. S.C.No.4 of 2023 on the file of the Special Court for Exclusive Trial of Cases under the POCSO Act, Thoothukudi, Thoothukudi District.

2. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. Hence, he seeks anticipatory bail to the petitioner.

3. The learned Government Advocate(Crl. side) submitted that the earlier bail granted to the petitioner. Since the petitioner had threatened the witness, bail was cancelled. Now the present petition has been filed seeking anticipatory bail. Hence, he opposed for grant of anticipatory bail to the 2/4

petitioner.

5. Considering the facts and circumstances of the case, and considering the fact that earlier bail was cancelled by the trial Court, this Court is not inclined to grant anticipatory bail to the petitioner. However, the petitioner is permitted to file a recall petition before the trial Court. On such filing of recall petition, the trial court shall consider the application on the same day.

6. With the above direction, this Criminal Original Petition is disposed of.
