PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 to 3 herein to take necessary action for cancellation of the Lay out approval granted to the respondents 5 and 6 herein in respect of the property comprised in S.No.413/2A2, 413/2B1A and 413/2B2A situated at Avaniyapuram Village, Madurai Corporation by considering the petitioner's representation dated 10.11.2024 and 14.07.2025 within the time stipulated by this Court. O R D E R

The present writ petition has been filed seeking a Mandamus directing the respondents 1 to 3 herein to initiate necessary action for cancellation of Lay out approval granted to the respondents 5 and 6 herein in respect of the property comprised in S.No.413/2A2, 413/2B1A and 413/2B2A situated at Avaniyapuram Village, Madurai Corporation, by considering the petitioner's representation dated 10.11.2024 and 14.07.2025. 2/5

2. According to the learned counsel appearing for the writ petitioner, the petitioner is having right over these survey numbers and therefore, without hearing him, the Lay out approval could not have been granted by the first respondent.

3. Since no adverse orders are passed, notice to the respondents 5 and 6 is hereby dispensed with.

4. Considering the above said facts, the first respondent is directed to conduct an enquiry, in the representation given by the petitioner on 10.11.2024 and 14.07.2025, after giving due opportunity to the respondents 5 and 6 and pass orders on merits and in accordance with law.

5. With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs.
