O R D E R

This Writ Petition is filed seeking a Mandamus as against the respondents 1 and 2 herein to conduct an enquiry before registering any deed as regards the property in S.No.9/6A2A1B1, New Survey No. 188/3 to the extent of 25 cents situated at Sakkottai Union, Sankarapuram Panchayat, Sekkalai Kottai Village, Karaikudi Taluk, Sivagangai District, on the basis of petitioner's representation dated 18.07.2025.

2. By consent, this Writ Petition is taken up for final disposal at the admission stage itself. Since no adverse order is going to be passed as against the 3rd respondent, notice to him is dispensed with.

3. According to the petitioner, with regard to the subject property, a civil suit is pending between the petitioner and his brother. Pending the suit, the third respondent has purchased the property from the brother of the petitioner and he is making an attempt to alienate the subject property. Hence, the petitioner has made a representation on 18.07.2025, before the respondents 1 and 2, seeking to conduct enquiry with regard to the subject property, before registering any document. 2/4

Since no action was taken by the respondents, the petitioner has filed this Writ Petition with the above said prayer.

The learned Special Government Pleader appearing for the respondents 1 and 2 would submit that the representation of the petitioner would be considered and if any document is presented for registration in respect of the subject property, after issuing notice to the petitioner, appropriate orders will be passed.

5. Considering the facts and circumstances of the case, this Court directs the respondents 1 and 2 to consider the representation of the petitioner dated 18.07.2025 and if any document is presented for registration in respect of the subject property, after issuing notice to the petitioner, the respondents 1 and 2 shall pass appropriate orders.

6. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs.
