Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus calling for the record relating to the Impugned refusal receipt issued by the SO of the 1st respondent by his office proceedings in ARN No. 25-2000127452 on 02.02.2025 and quash the same and consequently, direct the respondents to re-issue the passport to the petitioner's husband based on his passport application vide file No. SB2075450804725. 1/5

O R D E R

The present writ petition has been filed to quash the impugned refusal receipt issued by the first respondent and direct the second respondent to reissue the passport to the petitioner's husband based upon his passport application.

2. According to the learned counsel appearing for the writ petitioner, the petitioner's husband is in Riyat as on today and his passport has expired on 07.01.2026. When he attempted to renew the passport, it was not renewed on the ground that a criminal case is pending against him. Hence, the writ petition.

3. The learned Government Advocate (Crl.Side) appearing for the second respondent brought to the notice of the Court that the petitioner was implicated in a criminal case in Cr.No.891/2014 on the file of the 2/5

third respondent police station, which has culminated in filing of charge sheet in S.T.C.No.7425 of 2014 before the learned Judicial Magistrate, Melur. However, the said criminal case was settled in lok adalat and fine amount of Rs.300/- was paid in the year 2014 itself. Therefore, as on today, no criminal case is pending against the petitioner. The said fact is recorded.

In view of the above fact that as on today, no criminal case is pending against the petitioner's husband, there is no legal impediment for re-issuance/renewal of passport to the writ petitioner's husband. Therefore, the authority concerned is directed to reissue/renew the passport in favour of the petitioner's husband.

5. With the said observations, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed. NCS : Yes/No 29.01.2026 Index : Yes / No Internet : Yes / No apd 3/5
