PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to allot the Usilampatti Municipality land through Public Tender cum Auction in and around of Usilampatti Municipality by considering the petitioner's representation dated 28.11.2025 within the time stipulated by this Court. O R D E R

The present writ petition has been filed by one of the Ward Member of the third respondent Municipality seeking a Mandamus directing the respondents to allot the Usilampatti Municipality land through Public Tender cum Auction in and around of Usilampatti Municipality based upon the representation dated 28.11.2025.

2. The learned Additional Advocate General appearing for the third respondent brought to the notice of this Court that on 14.11.2025, an agenda 2/5

was placed before the Council for extending the lease period of the existing shop owners. The meeting was not conducted on that date and it was postponed. So far, decision has not been taken by the Council. He further submitted that as a ward member, the petitioner has to raise her objection in the council meeting.

3. In view of the above said facts, it is clear that the present writ petition has been filed prematurely without awaiting the result of the council meeting. However, liberty is granted to the petitioner to raise her objections before the council meeting.

4. With the above said observations, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently connected Miscellaneous Petition stands closed.
