This petition has been filed to condone the delay of 20 days in filing C.M.P. (MD) SR No.108633 of 2025 to restore C.M.P. (MD) No.10525 of 2024 in C.M.A. (MD) SR No. 30847 of 2024.
2. This Court, vide order dated 23.10.2025, directed the petitioner to deposit the entire amount within a period of four weeks as a condition precedent for condoning the delay in filing the appeal. It was made clear that if the deposit was not made within the time stipulated, the application would stand automatically dismissed.
3. The learned counsel for the petitioner submitted that the entire amount was deposited within the time stipulated by this Court. However, the memo came to be filed beyond the time limit and as a result, the petition stood automatically dismissed.
4. Considering the fact that the entire amount has been deposited, this Court is inclined to condone the delay and accordingly, the delay is condoned.
5. The Registry is directed to number the petition in C.M.P(MD) SR.No.108633 of 2025, if it is otherwise in order.
