The above petitions have been filed (i) to condone the delay of 1232 days in filing the petition for setting aside the abatement caused due to the death of the second appellant (ii) to set aside the abatement caused due to the death of the second appellant and (iii) to bring on record the petitioners 3 to 5 as legal heirs of the deceased second appellant and rank them as appellants 3 to 5 in the above appeal.
2. Heard the learned counsel appearing for the petitioners and the learned counsel appearing for the respondent.
3. The learned counsel appearing for the respondent would submit that they are not having any objections to allow these petitions.
4. Considering the reasons assigned and taking note of the submission made by the learned counsel appearing for the respondent, these petitions are ordered and the Registry is directed to carry out necessary amendments in the main papers and post the same on 24.03.2026.
