O R D E R

[Order of the Court was made by DR.G.JAYACHANDRAN, J.] This civil miscellaneous petition has been filed seeking to condone the delay of 335 days in the filing the above writ appeal.

2. Learned counsel appearing for the respondent sought time for filing counter when the matter came up for hearing on 08.01.2026 and 22.01.2026. However, till date she has not filed counter affidavit.

3. Further, on perusal of the records, we find that the issue involved in this matter has reached finality in favour of the employees and the special leave petition filed by the employer / State Government in the identical case before the Supreme Court has been dismissed. It is also brought to the notice of this Court that the review petition filed by the State Government against the order passed by the Division Bench of this Court in the identical case has also been dismissed. In the affidavit filed by the petitioners herein in support of the present condone delay petition, though the petitioners have made a reference of the appeals in respect of the similarly placed persons, the

results of the same have not been mentioned. In such circumstances, we are inclined to condone the delay.

4. Accordingly, this civil miscellaneous petition is allowed and the delay of 335 days in filing the above writ appeal is condoned.

5. Registry is directed to number the writ appeal, if the papers are otherwise in order, and post the same for admission in the usual course.

6. Learned counsels appearing on either side are directed to place all the Judgments rendered in the matter of similarly placed persons before this Court when the writ appeal is taken up for admission. [G.J., J.] [K.K.R.K., J.] 05.02.2026 NCC :
