ORDER

This criminal original petition has been filed seeking a direction to the first respondent to take appropriate action against the fourth respondent in the light of the petitioner's complaint dated 21.11.2025. 2.The learned counsel for the petitioner submitted that there was a dispute between the petitioner and the respondents 5 and 6 with respect to a land measuring two acres, comprised in Survey No.434, Periyammapatti Village, Palani Taluk, Dindigul District and in this regard, a civil suit in O.S.No.5 of 2012 was filed before the learned District Munsif Court, Palani, which was decreeded in favour of the petitioner and against the respondents 4 and 5. However, the respondents 2/6

4 and 5 preferred an appeal in A.S.No.34 of 2012 before the Subordinate Court, Palani, which was also dismissed against the fifth respondent. Thereafter, the fifth respondent filed a second appeal in S.A(MD) No.429 of 2019 before this Court and the same is still pending. Keeping in mind that there is no interim order in the said second appeal, the petitioner had arranged to cut the coconuts from the coconut trees which was interrupted by the fourth respondent police. Hence this petition has been filed seeking a direction to the first respondent to take appropriate action against the fourth respondent who has harassed the petitioner herein. 3.The learned Government Advocate appearing for the respondent submitted that based on the complaint given by the respondents 5 and 6 herein against the petitioner, CSR No.1186 of 2025 was registered and an enquiry was conducted and there was no harassment on the part of the respondent police.

4.Recording the same and keeping in mind the representation made by the learned counsel for the petitioner, this Court directs the third 3/6

respondent not to meddle with the civil case pending between the petitioner and the respondents 5 and 6. It is made clear that the respondent police shall not cause any hindrance to the petitioner in enjoying the property till the disposal of the second appeal. 5.With the above direction, this Criminal Original Petition is disposed of.
